Managing director pleads guilty to providing false information
A 59-year-old managing director in Malaysia, Goh Hee Seng pleaded guilty to two charges under Section 364 (2) of the Companies Act 1965 for providing false information to the Company Registrar with regards to an application to strike off a company name under Section 308 (1) of the same act.
According to the charge sheet, the accused had provided the false information in the application dated March 13, 2011 for the companies, Bukit Nilai Development Sdn Bhd (95650-X) and Build Through Engineering Sdn Bhd (620216-P).
Both the applications were accompanied with a statutory declaration from the accused that the companies did not have any assets or liabilities.
Investigations by the Companies Commission of Malaysia (CCM) found that Bukit Nilai Development and Build Through Engineering at the material time still owed another company – Seng Hiap Glass Sdn Bhd (86245-A).
On July 28, 2017, the accused was brought before Ahmad Fairuz Mohd Fuzi at the Sessions Court in Seremban where he pleaded guilty to both charges as soon as they were read out to him.
The court later imposed a RM20,000 fine or three months imprisonment in default of payment for each offence. The accused paid the RM40,000 fine for both offences.
The CCM views these offenses seriously as it affects the credibility and integrity of the information kept by the CCM.
CCM senior prosecutors Mohd Fairuz Othman and Muhamad Afif Abdullah prosecuted, while the accused was represented by Lee Kok Wah.
